- Account means a unique account created for You to access our Service or parts of our Service.
- Website refers to OpticWise, accessible from https://www.opticwise.com.
- Service refers to the Application or the Website or both.
- Country refers to: Colorado, United States.
- Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.
- Third-party Social Media Service refers to any website or any social network website through which a User can log in or create an account to use the Service.
- Personal Data is any information that relates to an identified or identifiable individual.
- For the purposes of the CCPA, Personal Data means any information that identifies, relates to, describes or is capable of being associated with, or could reasonably be linked, directly or indirectly, with You.
- Cookies are small files that are placed on Your computer, mobile device or any other device by a website, containing the details of Your browsing history on that website among its many uses.
- Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.
- Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
- Do Not Track (DNT) is a concept that has been promoted by US regulatory authorities, in particular the U.S. Federal Trade Commission (FTC), for the Internet industry to develop and implement a mechanism for allowing internet users to control the tracking of their online activities across websites.
- Business, for the purpose of the CCPA (California Consumer Privacy Act, as amended by the California Privacy Rights Act — together, "CCPA/CPRA"), refers to the Company as the legal entity that collects Consumers' personal information and determines the purposes and means of the processing of Consumers' personal information, or on behalf of which such information is collected and that alone, or jointly with others, determines the purposes and means of the processing of consumers' personal information, that does business in the State of California.
- Consumer, for the purpose of the CCPA/CPRA, means a natural person who is a California resident. A resident, as defined in the law, includes (1) every individual who is in the USA for other than a temporary or transitory purpose, and (2) every individual who is domiciled in the USA who is outside the USA for a temporary or transitory purpose.
- Sale, for the purpose of the CCPA/CPRA, means selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a Consumer's Personal Information to another business or a third party for monetary or other valuable consideration.
- Sharing, for the purpose of the CCPA/CPRA, means sharing, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a Consumer's Personal Information by the Business to a third party for cross-context behavioral advertising, whether or not for monetary or other valuable consideration.
- Sensitive Personal Information, for the purpose of the CCPA/CPRA, means Personal Information that reveals a Consumer's social security, driver's license, state identification card, or passport number; account log-in or financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account; precise geolocation; racial or ethnic origin, religious or philosophical beliefs, or union membership; the contents of mail, email, and text messages (unless the Business is the intended recipient); genetic data; biometric information processed for the purpose of uniquely identifying a Consumer; and Personal Information collected and analyzed concerning a Consumer's health, sex life, or sexual orientation.

Tracking Technologies, Cookies, and Google Consent Mode v2
We use cookies and similar tracking technologies to track the activity on Our Service and store certain information. We also use browser localStorage to persist Your cookie consent preferences. Learn more about cookies: All About Cookies.
This Site implements Google Consent Mode v2, Google's framework for adjusting how Google tags behave based on Your consent choices. Google Analytics 4 (GA4) loads on every page with all consent categories set to denied by default. In this state, GA4 sends cookieless pings — anonymous, aggregate signals that do not store cookies on Your device and cannot identify You individually. When You explicitly accept analytics cookies, the consent state is updated to granted and GA4 switches to full cookie-based measurement. If You reject analytics, only cookieless pings continue. Cookie Consent and How to Withdraw
When You first visit the Site from a region covered by the GDPR, ePrivacy Directive, or equivalent regulations (detected via Your timezone), a consent banner gives You three options: Accept All, Reject All, or Manage Preferences (with per-category toggles). Your choice is stored in localStorage (key: ow_consent) for 13 months, the maximum allowed under GDPR.
If Your timezone does not correspond to the EU/EEA/UK, the banner does not appear and all cookie categories are enabled by default. You can still change Your preferences at any time.

Analytics cookies (_ga, _ga_*) are only set after You accept analytics cookies via the consent banner. If You reject or do not interact with the banner, GA4 sends cookieless pings only — no tracking cookies are set.

Legal Basis for Processing (GDPR, Art. 6)

International Data Transfers
OpticWise is based in the United States. If You access the Site from outside the US — including from the EEA, UK, or Switzerland — Your Personal Data may be transferred to and processed in the United States, where data protection laws may differ from those in Your jurisdiction.
For Google Analytics data, Google LLC processes data under its Data Processing Terms and relies on Standard Contractual Clauses (SCCs) approved by the European Commission for transfers of EEA personal data to the US. We have configured GA4 with default settings (no Google Signals, no advertising features, no remarketing).

SMS/Text Messaging
OpticWise may send You SMS or text messages related to Your inquiry when You explicitly opt in on a form on Our Website — for example, by checking the SMS consent checkbox on Our contact or review request forms at opticwise.com/contact. Consent
Consent to receive text messages is not a condition of purchasing any goods or services from OpticWise. You opt in only by checking the SMS consent checkbox on an OpticWise web form (the checkbox is unchecked by default). Providing a phone number alone does not constitute consent.
Opt-Out
You may opt out of receiving text messages at any time by replying STOP to any message You receive from Us. After opting out, You will receive a final confirmation message and will no longer receive text messages from this program. Other keywords that will unsubscribe You include: OPTOUT, CANCEL, END, QUIT, UNSUBSCRIBE, REVOKE, and STOPALL.

Mobile Information Sharing
We do not sell, share, or provide mobile phone numbers, SMS opt-in data, or messaging consent to third parties or affiliates for marketing or promotional purposes. Mobile information collected as part of Our SMS messaging program is used solely to deliver the messages You have requested and to administer Your messaging preferences. This restriction applies regardless of any other data-sharing provisions described elsewhere in this Privacy Policy.
Retention of Your Personal Data
The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. Exercising Your California Privacy Rights

We will respond within 45 days of receipt; this period may be extended once by an additional 45 days when reasonably necessary, with prior notice to You. There is no fee for exercising these rights unless requests are manifestly unfounded or excessive. The California Privacy Protection Agency (CPPA) and the California Attorney General enforce the CCPA/CPRA; You may also lodge a complaint with the CPPA at cppa.ca.gov.
Sale or Sharing of Personal Information
We do not sell or share Personal Information as those terms are defined by the CCPA/CPRA, including for cross-context behavioral advertising. If Our practices change, We will update this Policy and provide any opt-out mechanisms required by law. "Do Not Track" Policy as Required by California Online Privacy Protection Act (CalOPPA)
Our Service does not respond to Do Not Track signals.
However, some third party websites do keep track of Your browsing activities. If You are visiting such websites, You can set Your preferences in Your web browser to inform websites that You do not want to be tracked. You can enable or disable DNT by visiting the preferences or settings page of Your web browser.
Children's Privacy
Our Service does not address anyone under the age of 13. We do not knowingly collect personally identifiable information from anyone under the age of 13.
